Subscription and Terms of Use

These Terms govern the use of AtyKids, its personal space and its paid subscription. By using AtyKids, you accept these terms. They complement the Legal notice and the Privacy Policy.

1. Purpose

AtyKids provides adults with tools designed to help them support children in everyday life. These terms define the framework within which those tools may be used.

2. A tool for adults

• AtyKids is a tool intended for adults.
• AtyKids's conversational spaces are meant for the adult who supports the child and are not designed to be used by a child alone.
• The adult remains responsible for how they use the tool and for the decisions they make.

3. A non-medical framework

• AtyKids makes no diagnosis.
• AtyKids gives no medical advice.
• AtyKids does not replace professionals.
• The adult keeps the decision: AtyKids may suggest, organize or rephrase, never decide in their place.

AtyKids is in no way a substitute for the advice, diagnosis, or follow-up of a health, education, or social-care professional.

4. Your account

Access to the personal space requires an account. You are responsible for keeping your credentials confidential and for the activity carried out from your account. Let us know of any unauthorized use.

5. Free and Premium features

AtyKids offers free resources available without an account (the Guides, the Glossary and AtyKids SAFE), free features available with an account, without payment, and Premium features available through a paid subscription. The exact scope of each tier may change and is shown on the Pricing page and in your personal space.

6. Subscription, billing and renewal

• The subscription is offered on a monthly or annual basis. The prices in effect are those shown on the Pricing page and on the subscription screen at the time of purchase.
• Prices in euros, US dollars, and Canadian dollars are independent commercial prices (not a currency conversion). Payment is charged in the currency actually selected and confirmed at checkout.
• Premium plans do not include an automatically available free trial when subscribing. The annual plan is simply a lower recurring annual price than twelve monthly payments ("2 months free" is a commercial comparison, not a genuinely free month or a trial).
• AtyKids may, however, at its discretion, occasionally grant selected users temporary complimentary access to some or all Premium features, including for discovery, partnership, evaluation, or specific promotional purposes. Such access is not a paid subscription, does not result in automatic charges, and does not create a right to renewal or to receive another complimentary access period. When that access expires or is revoked under the conditions of the program concerned, the account returns to the access level otherwise applicable, unless the user has separately purchased a Premium plan.
• Billing is charged in advance for the upcoming period (the month for monthly, the year for annual).
• The subscription renews automatically at each term (month to month for monthly, year to year for annual) until it is cancelled.
• Payments are handled by our provider Stripe. Your card details do not pass through our servers.

7. Cancellation

You may cancel your subscription at any time from your personal space (Stripe management portal). Cancellation stops the automatic renewal: it takes effect at the end of the period already paid (end of the current month for monthly, end of the current year for annual). Your access to Premium features remains active until that date, then ends, unless a mandatory legal provision requires otherwise. Account deletion is only possible once the subscription has completely ended.

8. Right of withdrawal (EU consumers)

If you are a consumer residing in the European Union, you may benefit from a 14-day right of withdrawal from the purchase, under the conditions set by applicable law. AtyKids is an online digital service (software), not a mere downloadable file. The steps and a model form are on the Right of withdrawal page. For any question, contact contact@atykids.com.

8a. The complimentary CANOPY ebook

An eligible first annual subscription opens the right to one CANOPY ebook, offered by SLOWO. It is digital content not supplied on a tangible medium: a file, not access to the AtyKids service.

You choose your book and its language from your account, with no deadline. Two options are then open to you:

• Receive it immediately. If your withdrawal period is still running, we ask for two separate, not pre-ticked agreements: your express request that supply begin before the end of that period, and your acknowledgement that you will consequently lose your right of withdrawal for that book. We then send you confirmation by email.
• Wait. You are never required to give those agreements. Once the 14-day period has passed, your book is chosen and downloaded with no formality of that kind. Your right stays open, with no expiry.

This rule concerns the book only. It carries no waiver of the right of withdrawal attached to your Premium subscription, nor of any of your other rights. In particular, your statutory guarantees and your remedies where content is defective or not as described remain intact.

If your first annual subscription is refunded in full before you have confirmed your choice, the right to the book ends with it.

9. Refunds

Apart from applicable mandatory legal rights (including the right of withdrawal above where relevant), the subscription does not give rise to an automatic refund of periods already paid. Any request is reviewed on a case-by-case basis.

10. Fair use, security and availability

Access to conversational and creation features is subject to reasonable measures for security, availability and the prevention of abusive or abnormally intensive use. These measures are intended to protect normal service operation for all users.

You agree in particular not to:

• misuse or disrupt the service, or attempt to compromise its security;
• carry out mass automated extraction of content (scraping, bots) or unintended automated use;
• share your account or credentials beyond your personal use.

We aim to provide reasonable availability, subject to maintenance and technical contingencies. In the event of a justified security breach or abuse, access may be suspended proportionately.

11. No guarantee of outcome

AtyKids is a tool to help with daily life. It guarantees no outcome regarding a child. The adult keeps the decision and remains responsible for their choices. AtyKids does not replace health, education or medico-social professionals (see section 3).

12. Intellectual property

The content, the AtyKids name and logo, the structure and the code of the service are protected (see the Legal notice). You keep your rights to the content you enter, and grant us the technical permissions strictly necessary to display it and provide the service.

13. Personal data

The processing of your data is described in the Privacy Policy. AtyKids applies strict data minimization and requests no data identifying a child.

14. Acceptance

When you first use the personal space, you are asked to accept these Terms and the Privacy Policy separately. No acceptance is implicit.

15. Changes to these terms

These terms may change. The update date shown at the top of the page prevails. A new version may require a new acceptance from you before you continue using the personal space.

16. Publisher and applicable law

The service publisher (Levis Global LLC) and the applicable law are specified in the Legal notice. The mandatory consumer-protection provisions of your country of residence remain applicable.
