AtyKids Referral Program Terms

These terms govern participation in the Recommend AtyKids program. They complement the Legal notice, the Subscription and Terms of Use and the Privacy policy.
By submitting an application and using a referral link or code, you accept these terms.
1. Purpose of the program
The program lets a person or an organization (the "referrer") introduce AtyKids through a personal link and code, and earn a commission when a paid subscription is taken out thanks to that referral.
The program grants no additional AtyKids features, opens no collective offer, and changes nothing about how a resource appears in ATLAS.
2. Eligibility and application
Applying is free and carries no commitment; it is done from the program page. It asks for a name, an email address, a profile, and optionally a country, a website or social handle, an audience size and a message.
You must be of legal age and have the capacity to enter into a contract. The information you provide must be accurate.
3. Acceptance by AtyKids
Every application is reviewed manually. No approval is automatic, and submitting an application does not amount to admission. AtyKids may decline an application without stating a reason, in particular where the profile is incompatible with the product's non-medical framing.
4. Partner account activation
Once an application is accepted, a partner account is activated. From your AtyKids personal space it gives you your link, your code, and the tracking of your referrals and commissions.
A partner account is either active or suspended. Only an active account records new attributions and gives rise to a payout.
5. Personal link and code
Your link takes the form atykids.com/r/YOUR-CODE. Your code can also be entered by hand when an account is created.
The link and the code are personal. They must not be resold, transferred, or presented as coming from AtyKids.
6. How a referral is attributed to you
When someone opens your link, an attribution cookie is placed in their browser. If they create an AtyKids account while that cookie is present (or if they enter your code) their account is linked to yours permanently.
No attribution is recorded if your partner account is not active at the time of the click, or if the person already has an account linked to another referrer.
7. Attribution window: 90 days
The cookie placed by your link lasts 90 days. After that, someone who has not created an account is no longer linked to you, unless they use your link again or enter your code.
This window describes how long a link can be recorded. It guarantees no commission: a commission exists only if a paid subscription is actually taken out and collected.
Once the account is created and linked, the attribution no longer depends on the cookie: it is stored and does not expire.
8. The first valid referrer wins
If several referral links or codes are used, the first valid link is the one that counts. An attribution already recorded is never replaced by a later one.
There is no "last click" rule.
9. 10% commission
The commission is 10% of the first eligible payment of the subscription taken out thanks to you.
The rate applied to each commission is fixed when that commission is created: a later change to the rate does not alter a commission already recorded.
10. First payment only
A commission is created once per subscription, on the first payment collected. A subscription can give rise to only one commission.
No commission is created if the first payment is zero, fails, or corresponds to a period with nothing collected.
11. Basis: the amount collected, excluding tax
The commission is calculated on the amount actually collected by AtyKids, excluding tax, after any discount. Tax is never part of the basis.
Payment provider fees are not deducted from the basis.
12. No commission on renewals
Renewing a subscription, monthly or annual, gives rise to no new commission. That remains true if the referred person stays subscribed for years.
The commission is not recurring, not residual, and not earned "for life". Participation in the program produces no regular income.
13. Refunds, cancellations and disputes
A commission follows the payment it comes from. You do not keep a commission on money AtyKids did not collect.
- Full refund: the corresponding commission is cancelled.
- Partial refund before payout: the commission is held while it is reviewed, then adjusted.
- Partial refund after payout: the share matching the refunded amount is identified as recoverable. Nothing is debited automatically from your account.
- Open dispute (chargeback): the commission is not payable until the dispute is resolved.
- Dispute resolved in AtyKids's favour: the commission becomes payable again.
- Dispute resolved against AtyKids: the corresponding commission is cancelled.
These adjustments concern only the commissions arising from the payments in question. The program creates no other debt on your side.
14. Validation period: 30 days
A commission becomes payable 30 days after the payment it comes from. This period is a safety window: it accounts for a refund or a dispute arising in the meantime.
During that period the commission is visible in your tracking but has not been paid out yet.
15. Payouts through Stripe Connect
Payouts are made to a Stripe Connect Express account that you create and control. Until that account is set up and able to receive funds, commissions remain due and pending: they are not lost.
Once a commission is payable and the account is ready, the transfer is triggered automatically. When the funds reach your bank account then depends on Stripe and its payout schedule: AtyKids cannot guarantee any specific banking date.
Payouts are made in the currencies the program supports (euro and US dollar). Where the settlement currency differs from the subscription currency, the conversion is carried out by Stripe.
16. Tax and social obligations
Amounts are paid gross of any charge. You remain solely responsible for the declarations and the tax or social obligations that apply to you in your country of residence.
AtyKids gives no tax advice. Identification details and any documents required for payout are collected directly by Stripe.
17. Fraud, manipulation and abusive methods
The following are prohibited, among others:
- creating fake accounts, fake subscriptions, or subscriptions taken out and cancelled for the sole purpose of generating a commission;
- manipulating attribution tracking by any technical means;
- sending unsolicited messages in breach of applicable regulation;
- impersonating AtyKids, or using its name or logo in a way that suggests you speak on its behalf;
- registering domain names, accounts or pages that suggest they are an official AtyKids site.
18. Self-referral
You cannot refer yourself. A subscription taken out with the referrer's own account gives rise to no attribution and no commission: the rule is enforced automatically.
19. Presenting AtyKids honestly
You undertake to present AtyKids accurately, and to claim nothing the product does not do.
You may recommend AtyKids through your own content, your social accounts, your site or your newsletter, and through a message sent to people who have agreed to receive it.
Generic paid advertising is allowed. It remains subject to these terms in full: the paid relationship is disclosed there as anywhere else, the trademark is not used misleadingly, and no promotion that AtyKids has not published is announced.
20. Disclosing the paid relationship
When you share your link or your code, you must state clearly that you may earn a commission. That disclosure must be readable in the same place as the recommendation itself, not pushed out of sight.
This obligation comes on top of the advertising and disclosure rules in force in your country, which continue to apply.
It never falls away because the space was paid for: an advertisement carries the same disclosure as an ordinary post.
21. Prohibited claims
When recommending AtyKids, you must never state, imply or suggest that:
- AtyKids makes a diagnosis, is a medical device, or gives medical advice;
- AtyKids replaces a health, education or social-care professional;
- AtyKids provides personalized legal advice;
- AtyKids guarantees an outcome for a child;
- the Premium subscription is free;
- a discount, a free trial or a preferential price exists when it is not published on the Pricing page;
- the CANOPY ebook offered with a first annual subscription is renewed, recurring, or attached to a renewal;
- AtyKids holds a certification, an approval or an endorsement it does not hold;
- your referral code opens a discount, a rebate or a preferential price: it identifies who recommended, it changes no price;
- a promotional code, a coupon or an exclusive offer exists when AtyKids has not published it;
- a comparison, a review or a testimonial is independent when it comes from you or has been fabricated.
22. The CANOPY book and the commission basis
The value of the CANOPY ebook attached to a first annual subscription is not deducted from the commission basis, and opens no additional commission.
23. Trademarks and intellectual property
The AtyKids name, its logo and all site content remain the property of their holder. The program allows you to name AtyKids and to use the visual material made available to you in order to recommend the product, in accordance with these terms.
This permission grants you no right in the trademark, ends with your participation in the program, and allows neither modification of the logo nor its use in a brand, product or domain name.
Without AtyKids's prior written permission, you may neither bid on the AtyKids name or any variant of it as a search-engine advertising keyword, nor make an advertisement appear as though it came from AtyKids.
Nor may you open an account, a page or a domain name liable to suggest that it is an official AtyKids channel. Recommending AtyKids means speaking in your own name, never in its name.
24. Suspension
AtyKids may suspend a partner account in case of fraud, manipulation of tracking, misleading claims, or a substantial breach of these terms.
A suspension stops new attributions from being recorded and holds the payout of pending commissions while the matter is reviewed. It is notified to the email address on your application, and you may respond to it.
25. Ending your participation
You may leave the program at any time by writing to contact@atykids.com. AtyKids may likewise end your participation, or the program itself.
Ending participation stops new attributions from being recorded. It does not terminate subscriptions already taken out.
26. Commissions already earned
Commissions already recorded are not deleted when participation ends. Those past the validation period remain due and are paid under the terms of clause 15, subject to the adjustments in clause 13.
Where an account is suspended for fraud or manipulation, payout of the commissions concerned is held while the matter is reviewed; commissions resting on fraudulently obtained subscriptions are not due.
27. Changes to these terms
These terms may change. The update date shown at the top of the page prevails.
A change applies only to referrals made after it is published: it does not call into question a commission already recorded.
28. Liability
AtyKids takes reasonable steps to make referral tracking and commission calculation accurate. The program nevertheless relies on elements outside AtyKids's control, in particular the referred person's browser, the persistence of the attribution cookie, and payment services.
AtyKids cannot be held liable for a referral that goes unattributed for one of those reasons, nor for lost earnings. Mandatory provisions that apply to you remain in force in any event.
29. Nature of the relationship
Participation in the program creates no employment contract, no general mandate, no partnership and no commercial-agency relationship between you and AtyKids. You act independently, in your own name, and cannot bind AtyKids in any way.
30. Personal data
The data processed within the program (application, referral code, attribution, commissions and payment references) is described in the Privacy policy, which also sets out your rights and how to exercise them.
Banking details and any identity documents requested for payout are processed directly by Stripe and are not kept by AtyKids.
31. Governing law and disputes
AtyKids is published by Levis Global LLC, a company incorporated under the law of the State of New Mexico (United States), which is your counterparty under the program. The program is governed by the law of that State, like the service as a whole: the publisher's full details are in the Legal notice.
For referrers residing in the European Union, the mandatory consumer-protection provisions of their country of residence continue to apply.
